Provisions concerning the privileged Entrepreneur apply to contracts concluded from 1 January 2021

§ 1 DEFINITIONS

Consumer –  a consumer within the meaning of Civil Code

Account –  A free of charge Store function regulated by separate provisions (service provided electronically ), due to which a Buyer can set up an individual account in the Store

Buyer – any entity buying in the store.

Privileged Buyer – Privileged Consumer of Privileged Entrepreneur

Privileged Entrepreneur –a natural person concluding an agreement with the Seller directly related to his business activity, but not having a professional character for him (the definition applies to contracts concluded from 1 January 2021)

Store –the IdeFly online store run by the Seller at https://idefly.eu.

Seller – an entrepreneur running a company under the name FLY-IDE GRAŻYNA RADCZYC-DOJLIDO, entered into the Polish Central Register and Information on Economic Activity kept by the Polish Minister responsible for economy and keeping the Central Register and Information on Economic Activity, Tax Identification Number (NIP)  8992205292, REGON number 932705650, Krakowska Street 180, 52-015 Wrocław, Poland.

§ 2 CONTACT WITH THE SELLER

§ 3 TECHNICAL REQUIREMENTS 

  1. For proper functioning and setting up an Account you need:
    • active email 
    • a device with internet access 
    • a web browser that supports JavaScript and cookies

§ 4 AN ACCOUNT 

  1. Setting up an Account is entirely voluntary and depends on the will of the Buyer.
  2. An Account gives the Buyer additional opportunities such as: browsing the history of orders placed by the Buyer in the Store, checking the status of an order or editing Buyer's data.
  3. In order to set up an Account, you must complete the appropriate form in the Store.
  4. At the time of creating an Account, an agreement is concluded for an indefinite period of time between the Buyer and Seller in the field of Account maintaining under the rules set out in these regulations.
  5. The Buyer may without incurring any costs at any time resign from the Account.
  6. In order to resign from the Account, one should send his resignation to the Seller on the following email address: biuro@ide-fly.net, which will result in immediate deletion of the Account and termination of the agreement concerning the Account.

§ 5 COMPLAINTS

  1. Complaints regarding the functioning of an Account shall be sent on email biuro@ide-fly.net.
  2. The complaint processing procedure will be closed within 14 days.

 

 

EXTRAJUDICIAL COMPLAINT AND REDRESS PROCEDURES

  1. In the event that the complaint procedure fails to produce the result expected by the Consumer, the Consumer may make use of, among other things:
    1. mediation conducted by a polish competent Voivodeship Inspectorate of Trade Inspection, to which a request for mediation should be submitted. As a rule, proceedings are free of charge. The list of Inspectorates can be found here: https://www.uokik.gov.pl/wazne_adresy.php#faq595;
    2. the assistance of a permanent consumer arbitration court operating at the Voivodeship Trade Inspection Inspectorate in Poland, to which an application for mediation should be submitted.     3. free assistance from the municipal or district consumer ombudsman;
  2. the ODR Internet platform available at: https://ec.europa.eu/consumers/odr/main/?event=main.home.howitworks..

§ 6 PERSONAL DATA 

  1. The administrator of the personal data provided by the Buyer while using the Account is the Seller. Detailed information on the processing of personal data by the Seller - including other purposes and grounds for data processing, as well as data recipients, is contained in the Privacy Policy available in the Store - due to the principle of transparency, contained in the general regulation of the European Parliament and of the Council (EU) on data protection - "GDPR".
  2. The purpose of processing the Buyer's data is to maintain the Account. The basis for the processing of personal data in this case is a contract for the provision of services or actions taken at the request of the Buyer aimed at concluding such a contract (Article 6(1)(b) of the GDPR), as well as the Seller's legitimate interest consisting in the processing of data in order to establish, assert or defend potential claims (Article 6(1)(f) of the GDPR).
  3. Providing data by the Buyer is voluntary, but at the same time necessary to maintain the Account. Failure to provide the data means that the Seller will not be able to provide the service of maintaining the Account.
  4. The Buyer's data will be processed until:
    1. the Account is deleted by the Buyer or the Seller on the request of the Buyer
    2. the possibility of asserting claims by the Buyer or the Seller related to the Account shall cease;
    3. the Buyer's objection against processing of his personal data is accepted - if the basis of data processing was a justified interest of the Seller
  5. - whichever is applicable in the case and whichever is the latest.
  6. The buyer shall be entitled to request:
    1. access to his personal data,
    2. rectification,
    3. erasure,
    4. restriction of processing,
    5. to have the data transferred to another controller
    6. as well as the right:
    7. to object at any time to the processing of data on grounds related to the Buyer's particular situation - to the processing of personal data concerning him based on Article 6(1)(f) of the GDPR (i.e. on legitimate interests pursued by the controller)..
  7. In order to exercise their rights, the Buyer should contact the Seller 
  8. In case the Buyer considers that his data are processed unlawfully, the Buyer may file a complaint with the President of the Office for Personal Data Protection

§ 7 RESERVATIONS

  1. It is forbidden for the Buyer to provide unlawful content.
  2. The agreement concerning the Account is concluded in the Polish language.
  3. In the event of the occurrence of important reasons referred to in paragraph 4, the Seller shall have the right to amend these Account regulations.
  4. The important reasons referred to in paragraph 3 are
    1. the need to adapt the Store to the legal regulations applicable to its activities
    2. improvement of the security of the provided service 
    3. change of Account functionality requiring modification of the Account Rules.
  5. The Buyer shall be informed of the planned change to the Account regulations at least 7 days prior to the change coming into effect through an email sent to the address assigned to the Account.
  6. In the event that the Buyer does not accept the planned change, he should inform the Seller about it, by sending an appropriate message to the Seller's email address biuro@ide-fly.net, which will result in termination of the agreement for maintaining an Account from the moment the planned change comes into force, or earlier if the Buyer submits such a request.
  7. If the Buyer does not object to the planned change until it comes into force, it is assumed that he accepts it, which does not constitute any obstacle for future termination of the agreement.
  8. In the case of a potential dispute with a Buyer who is not a Priority Buyer, the competent court shall be the court having jurisdiction over the Seller's registered office.
